Dwivedi had earlier complained that political parties should provide ECI assistance to fix any error, but were “not cooperating”, while voters are well aware of their rights.

Justice Surya Kant – presiding with Justice Joymalli Bagchi – sought an explanation whether only the individual (not a party or organization) could file an objection to showing an error in the role.

The ECI counsel replied that the case was not being treated very strictly, thus suggesting that Blass or political parties were also on freedom to object – while really stopping to stop saying so.

Advocate Prashant Bhushan in favor of the petitioners said, “We have seen a small sample. They say that 85,000 have come forward. Everyone whose name has been removed may not come forward. Many people are migrant workers, temporarily outside the state. Flood situation …”

Justice Kant, seems to be confident now, suggested that Blass should be able to help the local people.

Bhushan said that the state’s largest party, RJD, was only half of the constituencies, Justice Kant said that there could be more blas.

Bhushan then noted that another problem was that “they (ECI) are saying that anyone named who is not in the draft role, will now have to file a claim in Form 6. Form 6 claims to include a fresh voter, not for the improvement of entries”.

In addition, he said, although Form 6 usually requires just one declaration and an Aadhaar card, in this context, the ECI is demanding some additional documents out of the 11 specified 11. An explanation, Bhushan insisted, was necessary here.
